Terms of Service

These Terms of Service ("Terms") govern your access to and use of Hooksie (the "Service") operated by Hooksie ("we", "us"). By creating an account or using the Service you agree to these Terms.

1. The Service

Hooksie is a software-as-a-service tool that helps creators research short-form video trends and generate, schedule, and publish carousel-style TikTok posts using generative AI and the official TikTok Content Posting API.

2. Eligibility & accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction).
  • You are responsible for keeping your credentials secure and for all activity under your account.
  • You must provide accurate registration information.

3. Subscriptions, billing, and taxes (Paddle)

  • Merchant of Record. Paid plans and credit top-ups are sold by Paddle.com Market Limited (or its affiliates) as the Merchant of Record. Paddle handles payment processing, sales tax / VAT / GST calculation, invoicing, and chargebacks. Paddle's Buyer Terms and Privacy Policy apply to the transaction.
  • Recurring billing. Subscriptions renew automatically at the interval you selected until cancelled. You authorize Paddle to charge your payment method for each renewal.
  • Pricing. Prices are shown at checkout in your local currency where possible. Taxes are calculated by Paddle based on your billing location.
  • Cancellation. You can cancel any time from your account settings or via the Paddle receipt link. Cancellation stops future renewals; access continues until the end of the paid period.
  • Refunds. See our Refunds & Cancellation Policy.
  • Credits. AI generation consumes credits. Credits are not redeemable for cash and expire per the plan terms.

4. Acceptable use

You agree not to use the Service to:

  • Violate any law or the terms of any platform you post to (including TikTok's Terms of Service and Community Guidelines).
  • Generate or distribute content that is illegal, sexual content involving minors, harassing, hateful, defamatory, or infringes intellectual-property or privacy rights.
  • Impersonate any person or misrepresent affiliation.
  • Scrape TikTok or any third-party service in a way that violates that service's terms.
  • Circumvent rate limits, security features, credit metering, or authentication.
  • Publish spam, disinformation, medical/financial/legal misinformation, or content promoting self-harm, violent extremism, or regulated goods that TikTok prohibits.
  • Use the Service to build a competing product by systematic extraction.

We may suspend or terminate accounts that violate this section, and report unlawful activity to authorities where required.

5. TikTok integration

  • When you connect a TikTok account, you authorize us to call the TikTok Content Posting API on your behalf strictly to publish or schedule posts you create.
  • You are the author and publisher of any content posted from your account and are solely responsible for compliance with TikTok's policies.
  • You can disconnect at any time; tokens are deleted on disconnection.
  • We use TikTok data only as described in the Privacy Policy. TikTok is a trademark of its owner; Hooksie is not affiliated with, endorsed by, or sponsored by TikTok.

6. AI-generated output

  • Output is generated by third-party AI models and may be inaccurate, biased, or offensive. You are responsible for reviewing output before publishing.
  • Subject to your compliance with these Terms, we assign to you whatever rights we have in the output you generate. Similar or identical output may be generated for other users; we make no exclusivity guarantees.
  • You warrant that your prompts and inputs do not infringe third-party rights.

7. Your content

You retain ownership of the content you upload or generate. You grant us a worldwide, non-exclusive licence to host, process, transmit, and display your content solely to operate the Service (including delivery to TikTok when you request publication).

8. Intellectual property

The Service, including its software, design, and trademarks, is owned by Hooksie and its licensors. No rights are granted except as expressly stated.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT AI OUTPUT IS ACCURATE, LEGAL, OR SUITABLE FOR YOUR USE, OR THAT POSTS TO TIKTOK WILL SUCCEED.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA.

11. Indemnity

You will indemnify and hold us harmless from claims arising out of your content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

12. Suspension & termination

We may suspend or terminate your account for material breach, risk to the Service, or as required by law. You may terminate at any time by deleting your account.

13. Changes

We may update these Terms; material changes will be announced in-app or by email at least 14 days before taking effect for existing paid subscribers.

14. Governing law

These Terms are governed by the laws of the jurisdiction where Hooksie is established, excluding conflict-of-law rules. Nothing in these Terms limits your statutory consumer rights.
